Booking Terms and Conditions

1. Tour & Excursion Terms

Discover Sunshine Travel and its affiliated host agency, Nexion Canada ULC, utilize third-party tour and excursion operators (“Operators”) for all tours and shore excursions (“Excursions”). These Operators are independently owned and operated, and there are no joint ventures or co-sponsored activities between Discover Sunshine Travel and any Operator. All Excursions are subject to change or cancellation without prior notice. Operators reserve the right to deny participation to any guest based on their own criteria. Discover Sunshine Travel does not own, control, or operate any transportation company or service, nor any Operator.

Discover Sunshine Travel assumes no responsibility or liability for any damages, injuries, or lost baggage that may occur during or as a result of any Excursion. The company is not responsible for any negligent act, omission, or failure to act by the Operator, nor for any alleged negligence in selecting the Operator or offering its products. No representations or promises made by Discover Sunshine Travel override these General Conditions.

2. Assumption of Risk

Guests assume 100% of the risk associated with participating in any Excursion and agree not to bring any legal action against Discover Sunshine Travel or Nexion Canada ULC for any injury or damage occurring in connection with the planning, selection, or operation of any Excursion. To the fullest extent permitted by law, and in consideration of being allowed to participate, guests release Discover Sunshine Travel and Nexion Canada ULC, including their agents, representatives, employees, directors, and officers, from any claims or damages arising from participation in the Excursion.

3. Excursion Conditions

Excursions operate rain or shine unless otherwise notified by the Operator.

4. General Legal Terms

These terms apply to all travel booked or offered by Discover Sunshine Travel and Nexion Canada ULC, and to all causes of action a guest may have against them. Legal matters shall be governed by the laws of the country in which the cause of action arises. If in the United States, jurisdiction shall be exclusively in the federal and provincial courts in Ontario. Guests waive any right to a jury trial and agree that any recoverable damages are limited to the amount paid to Discover Sunshine Travel and Nexion Canada ULC for the cruise and Excursions.

These terms apply to the guest, any person to whom the guest assigns a booking, and any minors or others over whom the guest has authority to contract. By booking travel for a minor, the guest represents that they have the authority to bind the minor and agrees to defend and indemnify Discover Sunshine Travel and Nexion Canada ULC for any damages recoverable by the minor.
